1. Provider and Scope
These Terms and Conditions apply to all orders placed via the online shop ketools.shop with

(hereinafter “Kurth Engineering”, “we” or “us”).
These Terms and Conditions apply to orders with a delivery address in Switzerland. For deliveries abroad, supplementary or different provisions and mandatory rules of the respective country may apply.
Consumers are natural persons who acquire goods predominantly for personal or family purposes. Business customers are natural or legal persons who acquire goods predominantly as part of their commercial or professional activity.
By submitting an order, the customer confirms that they have taken note of these Terms and Conditions.
2. Offers and Product Information
The presentation of products in the online shop does not generally constitute a legally binding offer to conclude a purchase contract, but rather an invitation to the customer to place an order.
We endeavor to present and describe our products as accurately as possible. Minor deviations in illustrations, colors, packaging or versions remain reserved, provided the intended use of the product is not materially impaired.
In particular, the dimensions, specifications and technical data stated in the respective product listing are decisive.
Technical information, cutting data, application recommendations, rotational speeds, feed rates or comparable information are, unless expressly stated otherwise, intended as guideline values. The actually suitable operating parameters depend on the material used, the machine, workholding, toolholder, cooling and other operating conditions.
3. Conclusion of Contract
By completing the ordering process and clicking the corresponding order button, the customer submits a binding order for the goods contained in the shopping cart.
After receipt of the order, the customer will generally receive an automatic electronic order confirmation. This initially confirms only receipt of the order.
The purchase contract is concluded when we expressly confirm the order, hand the goods over for shipment, or deliver the goods.
We reserve the right to reject orders, in particular in the event of lack of availability, obviously incorrect prices, technical errors, payment problems or justified suspicion of misuse.
If payment has already been charged and we do not accept the order, the relevant amount will be refunded.
4. Prices
All prices displayed in the online shop for customers in Switzerland are stated in Swiss francs (CHF).
For offers to consumers, the stated prices include legally due public charges and other mandatory price components.
Additional shipping, delivery or, where applicable, other costs are shown separately before the order is completed.
The price displayed in the online shop at the time of the order is decisive.
Obvious pricing, typing, transmission or system errors remain reserved.
5. Payment
The payment methods displayed during the ordering process are available.
Unless otherwise stated for the respective payment method, the purchase price is due upon completion of the order or in accordance with the conditions of the selected payment service provider.
In the event of late payment, we may withhold further deliveries and, to the extent permitted by law, charge default interest as well as actual reminder and collection costs incurred.
Payments through external payment service providers are additionally subject to their respective contractual and privacy terms.
6. Delivery
Delivery is made to the delivery address provided by the customer when placing the order.
The available delivery methods, shipping costs and, where applicable, estimated delivery times are displayed in the online shop or during the ordering process.
Delivery periods are only binding if expressly designated as such. Otherwise, they are estimated delivery times.
Partial deliveries are permitted, provided they are reasonable for the customer and do not result in additional shipping costs that were not previously agreed.
If an order cannot be delivered because the customer provided an incorrect or incomplete address, the resulting additional shipping costs may be charged to the customer.
7. Delivery Delays and Unavailability
Delivery delays may occur in particular due to supply shortages at manufacturers, transport problems, customs clearance, force majeure or other circumstances outside our immediate control.
We will inform the customer of significant delays as soon as they become known to us.
If ordered goods are permanently unavailable or delivery becomes impossible, we may withdraw from the relevant contract or part of the contract. Payments already made for undelivered goods will be refunded.
Further claims remain reserved insofar as they arise from mandatory law.
8. Transfer of Benefit and Risk
For deliveries to consumers, the risk of accidental loss or accidental damage generally passes upon delivery of the goods to the customer or to a person authorized by the customer to receive them.
For business customers, the risk passes upon handover of the goods to the company commissioned with transport, to the extent permitted by law.
9. Inspection of Delivery
The customer is requested to inspect the delivery upon receipt for completeness, obvious damage and conformity with the order.
Transport damage should, where possible, be documented directly with the transport service provider and reported to us promptly.
Business customers must inspect the delivered goods upon receipt to the extent customary in business and report recognizable defects in writing or by email without delay, but no later than within five working days of receipt. Hidden defects must be reported without delay after discovery.
Mandatory statutory rights of consumers remain unaffected.
10. Warranty and Defects
We warrant that, upon delivery, the goods have the expressly warranted or ordinarily expected characteristics.
10.1 Consumers
For consumers, the mandatory statutory warranty period of generally two years from delivery of the goods applies, unless the law provides otherwise.
In a justified warranty case, we are entitled, at our discretion, first to carry out a professional repair or provide a replacement, provided this is reasonable for the customer.
If repair or replacement is impossible, fails, or is unreasonable for the customer, the customer is entitled to the further rights provided by law.
10.2 Business Customers
For business customers, the warranty period is, to the extent permitted by law and unless otherwise stated for the product, twelve months from delivery.
In the event of justified defects, warranty service is provided at our discretion by repair, replacement or credit.
10.3 Exclusions
In particular, no warranty applies to damage or impairment resulting from:
normal or use-related wear;
normal tool wear resulting from intended use;
improper use;
incorrect tool or product selection;
unsuitable cutting data or machining parameters;
exceeding permissible speeds or loads;
incorrect tool clamping or machine workholding;
collisions or machine errors;
improper storage;
unauthorized modifications or machining of the product;
use contrary to manufacturer specifications or generally recognized technical rules.
Natural wear of a cutting tool does not in itself constitute a defect in the goods.
Any manufacturer warranty applies in addition to the statutory or contractual warranty and is governed by the conditions of the respective manufacturer.
11. Returns and Withdrawal for Defect-Free Goods
Under Swiss law, ordinary online purchases generally do not provide a general statutory right of withdrawal or return.
Kurth Engineering therefore does not grant a general right to return defect-free goods unless expressly agreed otherwise in the respective product listing or in connection with an order.
A voluntary return may be accepted in individual cases following prior consultation. There is no entitlement to such acceptance.
For a voluntarily approved return, the products must generally be:
unused;
undamaged;
complete;
in a resalable condition; and
where possible, returned in the original packaging.
The customer generally bears the costs of a voluntary return shipment.
Special procurements, customer-specific products, specially manufactured or modified products, and cutting tools that have already been used are excluded from voluntary returns.
Warranty claims relating to defective goods remain unaffected.
12. Proper Use of Products
Some of the products offered through ketools.shop are tools and components for industrial or commercial machining.
Before use, the customer is responsible for checking whether the product is suitable for the intended machine, toolholder, application, rotational speed, load and material to be machined.
Products must be used exclusively for their intended purpose and in compliance with applicable safety regulations, machine manufacturer specifications and occupational safety requirements.
Required safety devices and personal protective equipment must be used.
If there is uncertainty as to the suitability of a tool, we recommend consulting us or the respective manufacturer before use.
13. Liability
Kurth Engineering is liable for damage caused by unlawful intent or gross negligence in accordance with statutory provisions.
Liability that may not be excluded or limited under mandatory law remains unaffected in all cases. This applies in particular to mandatory claims under product liability law.
To the extent permitted by law, liability for slight negligence is excluded.
In particular, to the extent permitted by law, we accept no liability for damage resulting from improper use, incorrect tool selection, unsuitable machining parameters, incorrect machine operation, exceeding permissible operating limits, or failure to observe safety instructions or manufacturer specifications.
Technical application recommendations and guideline values do not constitute a guarantee of a particular machining result, tool life or production performance unless such a guarantee has been expressly given in writing.
14. Force Majeure
To the extent permitted by law, we are not liable for delays or failure to perform obligations due to events over which we have no reasonable control.
These include in particular natural events, fire, flooding, epidemics, war, official measures, strikes, significant operational disruptions, energy or communication failures, and significant disruptions affecting transport, logistics or suppliers.
If such an event continues for so long that performance of the contract becomes permanently impossible or unreasonable, either party may withdraw from the contract with respect to services not yet performed. Payments already made for services not provided will be refunded.
15. Intellectual Property
All content of the online shop, in particular texts, product descriptions, images, graphics, logos, technical documents and other content, is, to the extent legally protected, the property of Kurth Engineering GmbH or the respective rights holders.
Any use, reproduction or redistribution beyond what is permitted by law requires the prior consent of the respective rights holder.
16. Data Protection
Personal data is processed in accordance with the Privacy Policy published on ketools.shop and the applicable statutory data protection provisions.
The Privacy Policy provides separate information on the nature, scope and purpose of the processing of personal data.
17. Changes to These Terms and Conditions
We may amend these Terms and Conditions as needed.
For an order, the version of the Terms and Conditions that was valid and accessible to the customer at the time the order was submitted generally applies.
Subsequent changes do not apply retroactively to purchase contracts that have already been concluded.
18. Severability
If any individual provision of these Terms and Conditions is wholly or partly invalid or unenforceable, the remaining provisions remain unaffected.
The applicable statutory provisions apply in place of the invalid provision.
19. Applicable Law and Jurisdiction
Swiss law applies, excluding the United Nations Convention on Contracts for the International Sale of Goods (CISG), to the extent such exclusion is permitted.
For business customers, to the extent permitted by law, the registered office of Kurth Engineering GmbH is the place of jurisdiction.
For consumers, mandatory statutory places of jurisdiction apply. These Terms and Conditions do not deprive consumers of any mandatory place of jurisdiction.
